700.108.
Representation, division of estate; posthumous children
Sec. 108. When representation is called for by section 106(a),
(c) or (d)1 the estate shall be divided into as many
equal shares as there are surviving heirs in the nearest
degree of kinship and
deceased persons in the same degree who left issue who survived
decedent, each surviving heir in the nearest degree receiving
1 share and the share of each deceased person in the same
degree
being divided among his issue in the same manner. Posthumous
children are considered as living at the death of their parent.
